Waiver and Release Agreement & Riding Survey

I acknowledge that horseback riding, hiking, and other back country activities have inherent risks, hazards, and dangers for anyone, that cannot be eliminated, particularly in a wilderness environment. 

 I consideration of WildCountry, LLC / WildCountry Packing furnishing services &/or equipment to enable me to participate in any provided outdoor activities such as camping, hiking, riding, hunting, fishing and any other such activity, I agree as follows: 

I fully understand the risks, hazards, and dangers and acknowledge that outdoor recreational activities have (a) inherent risks, dangers and hazards and such exists in my use of stock, equipment and trails; (b) my participation in such activities and/or use of such equipment and stock may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence of the owners, employees, officers or agents of WildCountry, LLC / WildCountry Packing, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature, or other causes. Risks and dangers may arise from foreseeable or unforeseeable causes including, but not limited to, guide decision making, including that a guide may misjudge terrain, weather, or trail , hazards and dangers that are integral to recreational activities that take place in a wilderness, outdoor or recreational environment; and (d) by my participation in these activities and/or use of equipment, I hereby assume all risks and dangers and all responsibility for any losses and/or damages whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers, or employees or WildCountry, LLC / WildCountry Packing, or by another person. above and have had the opportunity to discuss them with WildCountry, LLC / WildCountry Packing. 

If participating in a hunting activity, I acknowledge and accept the risk of handling firearms and being near others that have firearms in their possession and understand and agree that all guns are to be unloaded when not actively hunting. 

I understand that these activities may require good physical conditioning and a degree of skill and knowledge. I believe I have that good physical conditioning and the degree of skill and knowledge necessary for me to engage in these activities safely. I understand that I have responsibilities. 

My participation in this activity is purely voluntary. No one is forcing me to participate and I elect to participate in spite of the risks. 

I AM VOLUNTARILY USING THE SERVICES OF WILDCOUNTY, LLC (WILDCOUNTRY PACKING) WITH FULL KNOWLEDGE OF THE INHERENT RISKS, HAZARDS, AND DANGERS INVOLVED AND HEREBY ASSUME AND ACCEPT ANY AND ALL RISKS OF INJURY, PARALYSIS, OR DEATH. 

Lastly, I for myself, my heirs, successor, executors, and subrogees, hereby KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE AND RELEASE, INDEMNIFY, DISCHARGE AND HOLD HARMLESS WildCountry, LLC / WildCountry Packing, their owners, directors, officers, agents, employees, and volunteers from and against any and all claims, losses, actions, causes of actions, liabilities, suites, expenses (including reasonable attorney fees) which are related to, arise out of, or are in any way connected with my participation in this activity including, but not limited to, NEGLIGENCE of any kind or nature, whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, or death to me or my property as a result of my engaging in these activities or the use of these services, animals or equipment, whether such damage, loss, injury, paralysis, or death results from negligence of WildCountry, LLC / WildCountry Packing or any related entity, or from other cause, I, for my heirs, successors, my executors, subrogees, and myself further agree not to sue WildCountry, LLC / WildCountry Packing or any related entity as a result of any injury, paralysis, or death suffered in connection with my use and participation in the activities of WildCountry, LLC / WildCountry Packing. I am in good physical health and have the ability to safely engage in equine and other outdoor activities. 

I authorize WildCountry, LLC / WildCountry Packing to use my or my child's photo for sale or reproduction in any manner, for advertising, display, audiovisual, exhibition or editorial use. 

The Venue of any dispute that may arise out of this agreement or otherwise between the parties to which WildCountry, LLC / WildCountry Packing or its agents is a party shall be either the City of Baker, Oregon Justice Court or the County of State Supreme Court in Baker County. 

I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE. IT IS MY INTENTION TO EXEMPT AND RELIEVE WILDCOUNTRY, LLC / WILDCOUNTRY PACKING FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE FOR ME AND ANY MINORS IN MY CARE. 

Payment Policy: A 50% deposit is required for all activities. Until the 50% has been received, your reservation is NOT guaranteed.  The balance is due 30 days before your trip, camp or hunt date (unless other date is noted). Refund or roll over to a future date of any money paid is at the sole discretion of WildCountry, LLC / WildCountry Packing.

Parents of Minors: All children under 18 are required to wear helmets unless a parent approves riding WITHOUT a helmet. Should you choose to waive this requirement, please sign here:
